Programme of Work
How critical is the contractual compliance on the submission and approval of Programme of Works on a Construction Project? What are the pros and cons ?Please share your experience.

If the Programme of Work is what I believe it is, describing the sequence (schedule) of tasks to be completed, I believe compliance is critical if:
1. the Programme is tied to project milestones;
2. milestones are payable by the Buyer;
3. the Seller is billing the Buyer on completion of milestones.
Also, if the Programme is made part of the SOW, whether or not the tasks culminate in payable milestones, I believe the contractor must comply with this programme.

The Programme of Work is a contractual clause wherein the Contractor has an obligation to submit a construction/baseline schedule , in a time bound manner ,normally,within 2 weeks from issuance of Letter of Acceptance/Work Order, to the Client/PMC for their review and acceptance.In most of the cases,the implications/consequences of delay or non-compliance are not realized in time by the Contractor leading to conflict/dispute in interpreting the delays.
The programme of works is as important to comply with as the budget and any other contractual documents. Many take it lightly but if it was not followed then it will impact the whole project and will reflect negatively on other contractual clauses.
