Dear all,

Can I have your feedback on the below -

I am working on construction project and as part of the contract, we asked the bidder/contractor to develop a software to digitize all site works ( daily reports, payments, etc).

The contractor failed to automate the project as stipulated in the contract, however this doesn't adversely affect the project progress.

What action should be taken against the contractor?

If it is a deliverable and it is part of the project scope then let me say the answer is obvious.

if it is part of the approved scope and even the contract, the contractor owes it. Sometimes a contract provision is part of the product (the WHAT) and sometimes it is rather a requirement HOW to achieve the what. And this is sometimes regulated (does UAE require BIM in construction projects?). If it is regulated, the contractor must do it, not only for you but for government,

While you say the project process is OK in the moment, maybe future progress and future maintenance might be hampered without the automation, so there is a risk even beyond the project.

I would try to understand why the contractor does not fulfill this requirement and demand it formally.

Thanks Thomas for your input. Most probably, the contractor doesn't have a previous experience with the automation to do it in house, when checked the cost for outsourcing, it was higher than their estimated budget for this task.

Normally this type of requirement goes under Monitoring and Controlling and it’s not an actual deliverable.

If the contractor failed to deliver this, you can issue an official memo for starters asking them for an explanation and rationale.

The course of action to be taken should be in line with the penalties mentioned in the contract but I doubt there is a defined penalty for this specific requirement.
