Intellectual Property Ownership(IP)

What has been your experience handling Intellectual property ownership on your project, when it was not stated explicitly during the Initiating Phase i.e. ‘’who’’ will get ‘’what ‘’

I'm assuming you're working in a Client/Contractor relationship in this scenario, otherwise the IP ownership issue wouldn't generally be a concern. Given this assumption, ownership of intellectual property developed during the project should either be explicitly called out in the Terms of Service agreement made between the Client and Contractor, or documented as a subheading within the Project Charter.

Although there must be an explicit understanding but even if it is not there, one who is paying for the effort owns the Intellectual Property Rights for the outcome of the effort.
