In PMBOK, claim management and arbitration management is not addressed. Is there any provision to include that as both are very essential in todays project management.....Thnx Avijit Majumdar From EL

In PMBOK 5th revision, the claim management and arbitratio management are not addressed.

Can these be incorporated in next revisio.

Thanks

Dear Avjit,

Claim management is not general KA which can be frequently used for all application areas so that it might not be incorporated to next edition of PMBOK. But you can refer to Construction Extension to PMBOK 2nd Edition in which claim management is addressed even though it is not quite in detail.

Thank you for bringing up this discussion. Here are my personal views on why they need not be addressed more than what has already been dealt with:

Claims management: I agree with Sungjoon, it is not a general KA and hence might not be used by lot of projects spread across multiple industries.

Arbitration management: I consider arbitration more as a technique and there is a mention of arbitration/ADR as Tools and Techniques in the Close Procurements process in the PMBOK guide. Hence, I don't think it is necessary to go further deep into how it is being managed. That should be left up to the experts and they might not have anything to do with project management per se. The PMBOK provides guidelines for managing projects and defines project management related concepts (Pg 1 PMBOK guide). I don’t see arbitration management technically as a project management concept.

I would love to hear more, from experts in this area and PMI folks, on this discussion.

As Sungjoon and Venkata indicated, the PMBOK is not meant to be exhaustive. You often need to look elsewhere for details on specific tools and techniques.

Hi great points.

For arbitration, I would say it should be in the contract, so before PMBOK really get in.

Claim management should be in the procurement part for your sub contractor.

For both a key thing to keep in mind is that the both depend on legislation and PMBOK does not cover legal because it is dependent on your country or region
