Project Termination

I will have a meeting with the supplier CIO for software/hardware project. which has time frame 40 days to finalize the work, Now more than 2 years and did not implement what is agreed upon. Should I discuss with him technical defects and give them another chance, Or whether to negotiate with him to terminate the project and refund the amount submitted to them for the implementation of the project and how to do that.

It shouldn't take that time in the first place
you should follow the procedures...
but while you already lost all that time, terminate the project and found someone else qualified to do the job (another supplier)

I hope you have a contract, Work Authorization or MoU with the supplier.

Please visit the termination clauses, compensation or penalty in case of failure or technical defects of the project.

Refer to Contract Closer terms before you step forward to be on the safe side.

First of all,
Before any action in any issue as contractual, we should read the Clauses in the contract and follow them!! The termination should not be the first solution. You should have daily report, correspondence related any delays or issues, minutes of meeting if these are any poor performance. You should have full back up documents before any action. Although some client has authorization to terminate the as his default but it shouldn't first choice!!!!

Sounds like the project should have been terminated a long time ago.

You should not leave it until now, check the termination clauses, consult your legal dept, and then you can pull the trigger.
Have a look at any LD clauses both sides.

Thanks all for your reply, Unfortunately, there is no contract. However, it was dealt with by sending the PO after approval of their quotation. There is nothing to clarify the terms of termination of the deal.

For this case, you should refer to the client and make correspondence with him and record these correspondences for your reference and evidence!!!
